Terms of Use

Welcome to the Project Fuse site (the "Site"). These Terms of Use are entered into by and between you and Project Fuse Designs. (“Project Fuse”). The following Terms of Use and conditions, together with Legal Notices, Privacy Policy, disclaimers or terms and conditions that appear elsewhere on the Site, which are incorporated herein by reference, (collectively, the “Terms of Use”) govern you access to and use of the Site, including any functionality and services offered on or through the Site. Please read the Terms of Use carefully. By using the Site, you accept and agree to be bound and abide by these Terms of Use. If you do not want to agree to these Terms of use, you must not access or use the Site.

This Site is owned and controlled by Project Fuse and is operated with the assistance of certain third parties.

Project Fuse reserves the right to make changes to the Site and its Terms of Use at any time. If you are dissatisfied with the Site, its content or Terms of Use, you agree that your sole and exclusive remedy is to discontinue using the Site.

Indemnification

You agree to defend, indemnify and hold Project Fuse and its service providers harmless from and against any and all claims, damages, costs and expenses, including attorneys' fees, arising from or related to your use of the Site and/or your breach of these Terms of Use, including but not limited to User Content.

Intellectual Property Rights

Unless otherwise noted, the Site and its entire content, features and functionality (including all information, software, text, displays, images, video, audio, and the compilation thereof) are copyrights, trademarks, trade dress and/or other intellectual property owned, controlled or licensed by Project Fuse. All product environmental photography is copyrighted by Aniruddh Ghosh and Peyush Baranwal who has licensed use to Project Fuse. Access to this Site does not confer and shall not be considered as conferring upon anyone any license under any of Project Fuse’s or any third party's intellectual property rights.
The Project Fuse names and logos and all related product and service names, design marks and slogans are the trademarks or service marks of Project Fuse Designs. Access to this Site does not authorise anyone to use any name, logo or mark in any manner.

Changes to the Site

You agree and understand that the Site, including any and all features available via the Site and any User Content (as defined below), may be modified by us, in our sole discretion, at any time without prior notice. Unless expressly stated otherwise, any new features, new services, enhancements or modifications to the Site implemented after your initial access to the Site shall be subject to these Terms of Use.

Product Pricing, Availability and Accuracy

The prices herein are given in Indian Rupees and are retail prices excluding shipping charges,GST and other taxes.
Project Fuse does not accept any responsibility for misprints and/or mistakes in describing the characteristics of the products. The dimensions featured herein are nominal and are given in millimetres.
Each new price list supersedes all previous editions.

Product Display/Colours

The Site attempts to display product images shown on the site as accurately as possible. However, we cannot guarantee that the colour you see matches the product colour, as the display of the colour depends, in part, upon the monitor you are using.

Technical Changes

The technical specifications herein are indicative and Project Fuse reserves the right to alter them at any time and make improvements or changes, in its sole discretion, with a view to achieving better product quality.

Orders and Deliveries

Project Fuse reserves the right, in its sole discretion, to not accept orders from customers that are not in line with the company's instructions. The terms of delivery given on the order confirmation are indicative and expressed in working days. No damages can be claimed in the event of delays, suspensions or cancellations of deliveries.
Orders may only be changed or cancelled within one week of their receipt: this also applies to partial changes. The value of the goods will be charged should orders be cancelled when the goods are already in production and/or ready to be delivered.

Terms of Payment

The terms of payment are the terms indicated on the order confirmation according to the contractual arrangements made with the Customer.
In the event of non-payment or delayed payment, partial or otherwise, Project Fuse shall be entitled to stop or cancel any orders or deliveries in progress.

Claims and Complaints

Delivery by the carrier and receipt of the goods without complaint constitutes evidence that the goods delivered precisely match the goods ordered.
Any discrepancies must be detected by the customer when the goods are in the process of being handed over and must be reported in writing to the carrier, otherwise the complaint cannot be accepted.
Any complaints about the quality of products must be submitted in writing to Project Fuse within eight days of receiving the goods or the complaint cannot be accepted.

Warranty

In the event of defects in the goods attributable to Project Fuse, the relevant current Indian regulations shall apply.
The company disclaims all responsibility regarding assembly of the products. Project Fuse disclaims liability for damage resulting from failure to comply with the assembly instructions and/or from incorrect installation.

Changes in Shade and Colour

Wood, lacquered colours, fabrics, leather and other materials can be susceptible to colour change over time: if you wish to purchase items at a later date to add to your original order, any such variation cannot be cause for complaint.

Returns

Returns of goods will not be accepted unless authorised beforehand in writing by Project Fuse, who shall be entitled to inspect the goods in each case.
Under no circumstances can we accept returns of cut-to-size products.
Approved returns shall be made on a carriage paid basis and the refund you are entitled to shall be the invoice price minus any amount for deterioration or damage to the materials returned that cannot be attributed to Project Fuse resulting from transport, packaging, handling of the products or use thereof.

Non-Commercial Use

Ownership of the goods shall be retained by Project Fuse, until the price has been paid in full, even if further work is done on the products after delivery.
This Site and products sold through this Site are intended solely for the personal, noncommercial use of our customers and our potential customers. Our products are not being offered for re-sale unless previous, written authorisation has been provided.

Governing Law; Arbitration; Jurisdiction

The sale contract is governed solely by the laws of India. The parties submit to the exclusive jurisdiction of the Indian Court, more specifically to the State of Delhi, for the purpose of any dispute arising out of or in connection with the sale contract and, in general, business conducted with Project Fuse.
